Terms & Conditions
The "Essentials"
1. All Gardening offers a range of essential garden services that are paid for by a fixed charge paid in full for part hour or hour. These charges are
available to you via contacting the local branch or online at www.allgardening.co.uk.
2. Customers must pay the applicable charge on the commencement of their garden care either by cash, credit card, debit card or standing order.
The "Subscription Services"
3. All Gardening offers a range of different subscription service, some of which may not be available in every area. Details of these subscription services,
any restrictions pertaining to these subscription service, and the current charges and set up fees applicable to these categories are available
via you local branch office or online at www.allgardening.co.uk.
4. Customers must pay the applicable fees on the commencement of their garden care. This fee is a one-off charge made at the commencement of a
service. Except where All Gardening is in breach of contract this fee is non-refundable.
If a customer leaves and rejoins a new fee will be payable at the time of joining.
The subscription service is not transferable
5. The All Gardening subscription service is for twelve months (the commitment period), whether paying by standing order or annually in advance
This is a contractual commitment that binds customer and All Gardening.
6. Fees and charges are reviewed periodically. Customers will be given at least one month's notice in writing of any changes, which apply to customers
as follows:
(I) Monthly standing order payers must pay revised charges from the date at which it becomes applicable. During the Commitment Period,
should the relevant customer charge increase by more than 5% a customer paying monthly standing order may cancel his or her
subscription by giving notice in writing to All Gardening.
(ii) Customers who pay annually in advance will be subject to any revised charge after expiry of the year pre-paid.
7. One calendar month's written notice must be given to termination of subscription.
Except as detailed in Clause 4 (I) and in 9 termination cannot take effect before the expiry of the Commitment Period.
8. A customer wishing to change to a different subscription service must pay the appropriate service charge and administration fees prevailing at the
time of changing service.
9. All Gardening reserves the right to close or withdraw any service with or without notice, for any period in connection with extreme weather conditions
or business maintenance that the Managing Director deems necessary.
10. All Gardening reserves the right to amend these terms and conditions at any time. At least one month's notice of any change will be given. Details
of any changes will be posted on the company website. Should any amendment to the terms and conditions take effect before the end of the
Commitment Period, the customer will have the right to terminate the contract by giving one months written notice.
The "Essentials" & "Subscription Services"
11. Customers using All Gardening services do so at their own risk.
12. All Gardening takes all reasonable care to keep all information connected with your essential or subscription service secure but we cannot be held
liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide
when accessing or ordering from our Web Site, unless this is solely due to our negligence
13. All Gardening accept unlimited liability for death or personal injury caused by our negligence.
If you have a valid claim in respect of any of Goods or services which is based on any defect in their quality or condition or their failure to meet specification
in accordance with the Contract you will be entitled to choose either a refund of the price of the Goods or services or replacement Goods free of
charge.
All Gardening shall not be liable to you in connection with any contract, in tort (including negligence), contract or otherwise for any loss of profit, anticipated
savings or data that your business may suffer. We shall, however, be liable for losses that you suffer as a result of our breach of contract and
that could have been contemplated by both you and us at the time the contract is concluded.
